The best defense to arrest for assault is to make a "citizen's arrest" of the real perpetrators of the assault, or at least attempt to make that arrest. A defendant is already under arrest for "intoxication" BEFORE a blood alcohol test is "volunteered" by a defendant, and police can NEVER release a defendant by dropping charges for risk of civil lawsuit for false arrest and false imprisonment, or arrest for kidnapping and assault, so there is no way to pass such an alcohol "test".

The Fifth Amendment to US Constitution allows you to keep silent. By confessing to police or on the radio to "drinking alcohol in a bar", you have confessed to an essential element of the crime. The reason there is a 0.00% BAC/BAT "failing score" is because blood alcohol tests are NOT required for conviction. All that's required is for one witness (cop) to testify a defendant "slurred words", "smelled of alcohol" (pure alcohol has no smell), "talked too much", etc.

You need to sign a notorized affidavit attesting to the basic facts of saving a victim of an assault, listing names, dates, times and addresses, including names of the cops involved.

You need a notorized statement from the victim attesting that you did not attack him.

You need to sign a notorized "Affidavit of Probable Cause for Criminal Complaint" against the perpetrators of the original assault, AND against the cops for feloniously assaulting you, kidnapping you, and for false arrest and false imprisonment. This needs to be filed NOW with the court case deciding your fate, and is the equivalent to a "counterclaim" in civil cases. I have done this numerous times, and it ALWAYS works to dismiss charges, and get the cops demoted, and I got over 100 govt employees fired, regardless of rank.
